Sorry this is a little off topic, but a colleague wanted to
know if anyone had videotaped the first part of the
miniseries Dinotopia. She offered to pay for a tape and
postage if anyone can make and send a copy.

This makes me a bit uncomfortable as this seems to be a violations of
copyright laws and probably shouldn't be asked on a professional list.

I'm certainly not an attorney, but I think that it is perfectly cricket to
tape off TV *as long as you do not attempt to make a profit off what you
tape*. In fact, as I recall, there was a lawsuit about this exact subject
back when VCR's first became generally available. If it was illegal to
tape, why would the capability be allowed in an aboveground manner? Tapes
and players would have to be purchased clandestinely, as drugs are. Just
*my* opinion.

I think you may have misunderstood what bothered me. Of course, you can
tape something for your personal use but I believe, and I'm not an
expert, that the copyright infringment would be making a copy of that
tape for someone else. Certainly not something I would do professionally.

Note: I am not a lawyer, nor do I play one on TV, BUT:
The argument appended below, which is commonly held by many people, and
seems on the surface to be "fair" and reasonable, strikes me as extremely
unlikely. The production companies make good money marketing copies of
television programs after they are aired -- witness the bucks that I have
personally spent for Buffy episodes and the miniseries "Walking With
Dinosaurs." Even if you do not charge admission, you are potentially
taking money away from these companies if you tape them for other people,
and *especially* if you show them to groups. whether or not you charge
admission.

Many producers will freely give permission to libraries and other
educational institutions to screen such productions. Many others don't
feel that it's worth the effort to vigorously police such copyright
infringements. But just because this behavior isn't prosecuted doesn't
mean that it is not, to put it bluntly, stealing someone else's
intellectual property, and should not be encouraged or promoted by anyone
in our profession.
